CMO COUNCIL ("us", "we", or "our") operates the www.cmocouncil.org website (the "service") along with microsites as noted below.

This page informs the user (“you”, “your”, “members”, “subscribers” or “non-members”) of our policies and practices regarding the collection, use, and disclosure of personal data and the choices you have associated with that data.

We use your data to provide and improve your engagements with us and to notify you of new opportunities to engage with us, connect with others in our network and access content. CMO Council members, upon application of membership, agree to the collection and use of information in accordance with this policy. Subscribers agree to the collection and use of information in accordance with this policy upon registering for or purchasing subscription or content services. Non-members agree to the collection and use of information in accordance with this policy upon use of the service including, but not limited to, downloading content and registering for events both live and virtual.

Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use, accessible from www.cmocouncil.org

Definitions

  • Content
    Content includes reports, webinars and white papers that are blocked behind a form.
  • Content Providers
    Third-party providers of syndicated content, including white papers, webinars, podcasts and research reports.
  • Cookies
    Cookies are small pieces of data stored on your device (computer or mobile device) used to authenticate log ins and store form field information.
  • Data Controller
    Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for and the manner in which any personal information is being, or is to be, processed. For the purpose of this Privacy Policy, we are a Data Controller of your Personal Data.
  • Data Processors (or Service Providers)
    Data Processor (or Service Provider) means any natural or legal person who processes the data on behalf of the Data Controller.   • Sponsor Partners
    Dedicated sponsors of CMO Council research; will be listed as co-partners on any research that an individual company has sponsored.

    Externals who provide services or functions on our behalf, which may include marketing, survey distribution, program promotion, payment processing, and fraud prevention.
  • Usage Data
    Aggregated, non-personally identifiable information collected from data that is generated from the use of the Service (for example, the duration of a page visit).

We collect multiple different types of information for various purposes to best provide and improve our service to you.

By sharing your Personal Data with us, you agree that the CMO Council can contact you by way of email, telephone, direct mail or other means of communication about announcements including, but not limited to:

  • The availability of new Content
  • Invitations to join events in your area
  • New services, features and solutions
  • Newsletters and timely Content briefings
  • Direct marketing or promotional material
  • Surveys

You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us directly at info@cmocouncil.org

If you are a CMO Council member or subscriber, you may opt out of receiving transactional emails, such as Privacy Policy and Terms of Use updates, membership portal access information, and payment processing details, by deactivating your membership or subscription. Usage Data
We may also collect information about how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (IP address), browser type, browser version, the time and date of your visit, the pages of our Service that you visit, the duration of your page visits, unique device identifiers and other diagnostic data.

Location Data
At this time, we do not currently collect “Location Data” via our Service. However, we reserve the right to, in the future, request permission to do so in an ongoing effort to improve and customize our Service.

Tracking Cookies Data
We use cookies and similar tracking technologies to track the activity on our Service and hold certain information.

Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Legal Basis for Processing Personal Data Under General Data Protection Regulation (GDPR)

If you are from the European Economic Area (EEA), our legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

CMO COUNCIL may process your Personal Data because:

  • We need to perform a contract with you
  • You have given us permission to do so

  • We need to handle payment processing
  • We are required to comply with the law

Retention of Data

CMO COUNCIL will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a relatively short time period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for a given time period.

CMO COUNCIL will take all steps reasonably necessary to ensure that your data is treated responsibly, securely and in accordance with this Privacy Policy and that no transfer of your Personal Data will take place unless there are adequate controls in place to ensure data security.

Data Sharing

We collect Personal Data on cmocouncil.org when you register to request Content from our Content Providers and Sponsor Partners, hereafter called Partners. By virtue of our relationship, our Partners may obtain Personal Data that Users voluntarily submit at the time of a third-party Content request.

When you register or submit a filled form to access a Partner’s Content, the use of your Personal Data is governed by their Privacy Policy and may be used by the Partner for follow up by telephone, email, direct mail or other common communication methods. You should contact our Partners directly if you have any questions about their use of your Personal Data.

We often offer products or services in conjunction with Sponsored Partners. Users are made aware of a Partner's involvement in a product or service when the Partner's name appears either in conjunction with our name or separately. If you choose to access Partner involved Content via our Service, we may share your Personal Data with the Partner. Please note that we do not control the privacy practices of our Partners and have no control over our Partners' use of your Personal Data.

We may also authorize Third-party Vendors and Service Providers to collect information on our behalf when said information is deemed necessary to facilitate operation of our Service. Third-party Vendors and Service Providers have access to and may collect information only as needed to perform their functions and are obligated not to disclose or use the information for any other purpose. They are not permitted access to or use of your Personal Data for operations not relating to our Service.

Usage Date may be shared with our Partners to help them fulfill behavioral advertising or business analytics needs. We also may share Usage Data publicly purely for records, reports, and analytics purposes. For example, we may publicly share collated and analyzed Usage Data to share trends in technology products and services or show rankings amongst product or service providers.

You can choose to access certain third-party social media websites and services (such as LinkedIn and Twitter) through our Service. When you do so, you are sharing your Personal Data with those sites. As such, your Personal Data will be governed by their Privacy Policies and we have no control over their use of your Personal Data. You may be able to modify your privacy settings within these third-party social media web sites.

CMO COUNCIL may disclose your Personal Data in the good faith belief that such action is necessary to:

If you are a CMO Council member or subscriber, you can access and amend your personal information by logging in to member portal. Users who have not unsubscribed from our communications will be able to access communication preferences in order to understand, expand or limit our use of your Personal Data. If you are unable to perform these actions by yourself, please contact us for assistance.
  • The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
  • The right to object. You have the right to object to our processing of your Personal Data.
  • The right of restriction. You have the right to request that we restrict the processing of your personal information.
  • The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.
  • The right to withdraw consent. You also have the right to withdraw any previously provided consent to process information, at any time

We may use multiple email distribution partners, Customer Relationship Management (CRM) systems, webcast providers or other solutions to perform Service-related services. To request more information about individual Service Providers, please contact us directly. We are happy to provide you with information related to our Service Providers’ commitments to government regulations, user privacy and data security.

Analytics
We may use the below third-party Service Provider to monitor and analyze the use of our Service.

  • Google Analytics
    Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. You can opt-out of having your activity on the Service made available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visit activity. Payments
We may provide paid products, subscriptions and/or features within the Service. In such cases, we do not store or collect your payment details and solely use third-party services for payment processing. Your payment information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort from brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. We may use the below third-party Service Provider as our payment processor.

Our Service does not address anyone under the age of 18 ("Children").
